Hhurried Epiphany in 2023 is the first public holiday that falls on a working day. But he is not free of work everywhere. January 6 is a public holiday only in Bavaria, Baden-Württemberg and Saxony-Anhalt.
But what does that mean for employees who live in Hesse, for example, and commute to Bavaria to work for a company that has its headquarters in Berlin?
The specialist portal “Haufe.de” clarifies the details: The federal state in which the employee lives is just as irrelevant as the company headquarters. The actual place of work is decisive.
So only those who actually work in Bavaria, Baden-Württemberg or Saxony-Anhalt are entitled to “The Three Kings” and still get the usual wages.
If employees have changing locations or a job that involves travel, the public holiday laws only apply to those who would be in the relevant federal state for work on the day in question. This is also the case if the employer has several registered offices.
However, the prerequisite is that the public holiday is actually associated with a loss of work. If you would not have worked that day anyway, for example because the public holiday falls on a Sunday, there is no entitlement to continued payment of wages.
Those who have taken the rest of the week off and have conjured up nine long winter holidays out of just four days can be particularly happy. There are many more opportunities for bridging days in 2023.
