A group of activists in the tribal areas of Madhya Pradesh have launched an austerity campaign among schedule caste/tribes to cut the people taking reservations from other states , according to the recent judgement by Supreme Court that the person belonging to a reserved category is entitled to claim the benefit of reservation in either of the successor states of Madhya Pradesh or Chhattisgarh ,but cannot claim benefit of quota simultaneously in both the the successor states upon their reorganisation in November ,2000.
Now, a group of intrepid tribal activists associated with three organizations – Mazdoor Chetana Sangath (MCS), Adivasi Ekta Parishad and Jai Adivasi Yuva Shakti have launched a movement to cap , because of this so many orginal natives have deprived from the educational rights specially in higher Education
For the past four months, the group has been holding meetings in tribal districts of Dewas, indore , Bhopal , ujjain with sarpanchs, Patels who are large land owners and other influential people of the villages to push through a consensus on the issue. On July 4, the group has called for a major meeting in Ujjain town to give a fillip to the movement.
After fresh complaint by an RTI activist filed on the basis of these documents, a high power scrutiny committee of the state tribal development department has taken the complaint against the doctor who is been resident of dewas Dr Pankaj Kujur who did his MBBS from Rd gardi medical college in Ujjain, and Md radiodiagnosis from indore .
Documents obtained under the RTI by activist sunil Tiwari show that the doctor Pankaj Kujur , had obtained caste certificates of both Chhattisgarh and Madhya Pradesh and appeared in medical entrance examinations manytimes in both states , and where he got selected he took advantage of being admitted to rd gardi medical college, and deprived a schedule tribe seat the advantage of being son of the soil principle. Since the communities are specified as SC or ST with reference to a particular State or part of the State, the status of a person does not change on migration to another State or another part of the State. For instance a person belonging to a SC/ST community in chhattisgarh, on migration to M.P. State will continue to be a SC/ST of chattisgarh and will not be treated as SC/ST in MP, even though his community is also specified as SC/ ST in relation to the State of MP. He will, however, be eligible to draw benefit as SC/ ST from the Central Government, like (i) reservation in services to be filled on all-India basis under the Central Government offices located in M.P. and elsewhere and (ii) admission to educational institutions located in M.P. and elsewhere but controlled/ financed/ regulated/ administered by Central Government. Similarly a person, resident of chhattisgarh and not belonging to either SC/ ST of the State on migration to M.P. State would not be treated as SC/ ST even though his/ her community is listed as SC/ ST in relation to M.P. State. there is a prime facie case of a false SC/ST certificate,of Pankaj kujur a reference to this effect may be made to the Collector of the concerned District to verify the genuineness or correctness of the certificate. In case the certificate is found false the disciplinary action against the false SC/ST certificate holder should be started immediately and the case also be reported to the police for instituting criminal provisions of the Indian Penal Code. And soon we will be filing a case against many more who has violated the Conduct Rules and concerned the benefits which are available to only those who are genuine SC/ST in the state. By doing so he has denied the right of reservation to a genuine SC/ST candidate. The services of such as fake certificate holder should be terminated and the seat so used should be filled from SC/ST for which it was originally reserved. The Government of Madhya pradesh should also issue and reiterate instructions to all its Ministries/ Departments and Public Sector Enterprises, educational and professional institutions and other bodies under its control to take necessary steps for proper verification of caste/ community certificates and for taking suitable action against the offenders.
