The European Union Commission has alerted X about its non-compliance with the Digital Services Act on several fronts. Elon Musk responded by denouncing the measure. What is the subject of the dispute and what are the issues at stake?
The European Union Commission attacks X
Friday, The European Union Commission has sent an opinion to the social network Xnoting several violations of the Digital Service Act (DSA).
While violations of Articles 25, 39 and 40 (12) are alleged, X would risk a fine of up to 6% of its annual turnover if formal proceedings were to be initiated.
For his part, Elon Musk reacted by denouncing “a secret and illegal agreement” and accusing the European Commission of censorship:
The European Commission offered an illegal secret deal: if we quietly censored speech without telling anyone, they would not fine us.
The other platforms accepted that deal.

Concretely, the premium service with the famous blue tick is one of the major points of the dispute. Indeed, it is accused of misleading users, inspiring a false sense of legitimacy towards certain accounts which could use it to promote scams for example.
Thierry Breton, Commissioner for the Internal Market at the Commission, addressed this point as well as the other facts alleged against X:
At the time, BlueChecks was synonymous with reliable sources of information. Today, with X, our preliminary view is that it misleads users and violates the DSA. We also consider that X’s advertising repository and the conditions for researchers to access the data do not comply with the DSA’s transparency requirements.
As the person concerned points out, the advertising aspect of the social network would also lack transparency for the user. In addition, access to public data, particularly through API connections, would be made too difficult, unless “ to pay disproportionate costs.”
